IN RE: Scott WHITE
OPINION AND ORDER
Scott White was admitted to the practice of law with the Kentucky Bar Association (KBA) on November 17, 1994. His KBA number is 85595, and his bar roster address is 184 S. Main Street Versailles, KY 40383.
Previously, in In re White, 706 S.W.3d 70 (Ky. 2024), this Court granted White's motion for negotiated sanctions pursuant to Supreme Court Rule (SCR) 3.480(2) in relation to Office of Bar Counsel (OBC) File 22-DIS-0216 and OBC File 22-DIS-0278. As part of that negotiated sanction, White agreed to be suspended from the practice of law for thirty days, probated for one year. He further agreed to several conditions, including: receiving a Kentucky Lawyer Assistance Program (KYLAP) assessment, complying with any recommendations made as a result of that assessment, and providing OBC access to any records held by KYLAP; providing his former client, Justin Tomey an accounting of the prepaid fee he received from Tomey and refund any unearned portion of that fee; not receiving any new disciplinary charges; timely payment of his bar dues; timely satisfaction of his continuing legal education requirements; and payment of the costs associated with the disciplinary proceedings. Id. at 74.
Our opinion granting his negotiated sanction was entered on December 19, 2024. On August 18, 2025, OBC filed a motion for a show cause order on the basis that White had failed to provide an accounting of Tomey's prepaid fee, had failed to refund any unearned portion of that fee, and had failed to provide proof to OBC that the unearned portion had been refunded. This Court granted OBC's request and entered a show cause order on September 4, 2025. White did not respond to the order and, in addition, he was suspended from the practice of law for failure to pay his bar dues on March 21, 2025.
Based on the foregoing, this Court holds that White has violated the terms of the parties’ negotiated sanction and hereby orders:
1.) Scott White shall be suspended from the practice of law for thirty days upon entry of this order;
2.) Scott White shall continue to comply with all recommendations of any KYLAP monitoring agreement and shall provide quarterly status updates to OBC confirming his compliance;
3.) Scott White shall sign authorizations allowing the OBC to review his records held by KYLAP, mental health professionals, social workers, and any and all medical records and mental health records;
4.) Scott White shall provide an accounting of the prepaid fee he received from Justin Tomey, refund any unearned portion of that fee, and provide proof of refund to OBC withing 30 days of this Order;
5.) Scott White shall receive no new disciplinary charges issued by the Inquiry Commission;
6.) Scott White shall timely pay his Kentucky Bar Association membership dues;
7.) Scott White shall timely satisfy all continuing legal education requirements; and
8.) Scott White shall pay the certified costs associated with these disciplinary proceedings in the amount of $534.89 pursuant to SCR 3.450.
