Pending before the Court is Appellants’ verified motion for immediate transfer pursuant to Indiana Appellate Rule 56(A). Appellees filed a response opposing the motion and Appellants filed a reply.
Having considered the parties’ submissions and being duly advised, a majority of the Court grants the Appellants’ motion for immediate transfer under Rule 56(A) and directs the Clerk to assign a Supreme Court case number, which shall be used for all future filings in this appeal. Pursuant to Rule 56(A), Appellants’ appeal shall proceed in this Court “as if it had been originally filed here.”
The Court ORDERS that the parties adhere to the following briefing schedule: The Appellants’ Brief shall be filed no later than Friday, May 22, 2026; the Appellees’ Brief shall be filed no later than Monday, June 21, 2026; and the Appellants’ Reply Brief shall be filed no later than Thursday, July 9, 2026. Extensions of these deadlines will be granted only for extraordinary circumstances. The Court will conduct oral argument on Thursday, September 10, 2026, at 10:00 a.m., with further details to be provided by separate order.
