Order
On August 27, 2025, the Court issued an order denying Ward's request to seek successive post-conviction relief and setting an execution date of October 10, 2025. On September 10, 2025, the Court denied Ward's petition for rehearing.
On September 18, Ward filed a motion to stay the execution. This motion asserts that on September 15, Ward filed a motion to intervene in McLachlan v. Ind. Dep't of Correction, No. 49D06-2505-PL-022086. The State filed a response opposing intervention on September 17. The trial court has not ruled on Ward's motion to intervene.
Being duly advised, the Court directs that any response to Petitioner's “Motion for Stay of Execution” be filed by 12:00 p.m. Monday, September 22, 2025, and any reply in support of the motion be filed by 12:00 p.m. Wednesday, September 24, 2025. The Court will then take the motion under advisement.
