This matter comes before the Court on a petition to transfer jurisdiction under Indiana Appellate Rule 57 after the Court of Appeals issued its opinion in In re C.C., 223 N.E.3d 238 (Ind. Ct. App. 2023), reh'g denied. In its opinion, the Court of Appeals noted that the trial court's permanency plan order included the first names of three children who were not subject to these proceedings. It cautioned the court “to include only the names of the children who are included in those cases” in future CHINS orders. Id. at 241 n.3. But this caution itself included the unredacted first names of the three children.
The Court has reviewed the petition to transfer and accompanying materials and discussed the petition in conference. Being duly advised, the Court GRANTS transfer, VACATES the Court of Appeals opinion, and REMANDS the case to the Court of Appeals to issue a revised opinion that does not publicly disclose the first names of the children listed in footnote 3.
