RE: ADOPTION OF THE RESOLUTION OF THE COURT OF APPEALS OF INDIANA IN MEMORY OF THE LATE EUGENE N. CHIPMAN, SR.
ORDER
The Court orders the foregoing Memorial Resolution spread of record upon the permanent records of this Court, and the Clerk of this Court is ordered to deliver a copy of said Memorial Resolution to West Publishing Company who is ordered to print and publish the same in the North Eastern Reporter.
IT IS FURTHER ORDERED that the Clerk of this Court transmit a copy of said Memorial Resolution, under seal of this Court, to Jim Hardin, Plymouth, Indiana; Susan Nichter, Carmel, Indiana; E. Nelson Chipman Jr., Plymouth, Indiana; Bryant Chipman Sr., Clearwater, Florida; and Kelsey Flynn, Plymouth, Indiana.

IN MEMORIAM
HONORABLE EUGENE N. CHIPMAN, SR.
The following resolution was adopted as a memorial to the late Eugene N. Chipman.
WHEREAS, the Honorable Eugene N. Chipman, Sr., a resident of Plymouth, Indiana, was a Judge of the Court of Appeals of Indiana; and
WHEREAS, it is with deep regret that we note the passing of Judge Chipman at age 94 on December 7, 2021; and
WHEREAS, Judge Chipman was appointed to the Court of Appeals upon the creation of a fourth district in 1978 and assumed office on August 1, 1978, and served until his retirement on October 26, 1981; and
WHEREAS, Judge Chipman was born and raised in Plymouth, Indiana. He graduated from Culver Military Academy in 1945 and then attended the University of Michigan until he was awarded an appointment to the United States Naval Academy, graduating in 1950 with an electrical engineering degree. After serving on a destroyer, an aircraft squadron based out of Norfolk, Virginia, and reaching the rank of Lt. Commander, Judge Chipman enrolled in law school at Indiana School of Law – Bloomington, receiving his J.D. in 1959; and
WHEREAS, Judge Chipman served as Prosecuting Attorney for the 72nd judicial circuit in Marshall County from 1962 to 1969, a part-time position at that time, and maintained a part-time civil practice; and
WHEREAS, Judge Chipman re-entered the private practice of law following his retirement from the Court of Appeals, joining his son, Nelson, just as his father had done with him over two decades earlier; and
WHEREAS, Judge Chipman ran for Judge of the Marshall Superior Court, was elected, and served one term. He ran for office again after leaving the Superior Court bench and became the Marshall County Commissioner, a position he held for two terms; and
WHEREAS, Judge Chipman held numerous leadership positions in organizations devoted to the improvement of legal services provided to the public and enjoyed lecturing to law school students about improving the use of demonstrative evidence in the courtroom. He was most proud of recruiting young and prestigious lawyers to the community, not the least of which included Martin Morrison and Jere Humphrey; and
WHEREAS, Judge Chipman was selected in 1994 to be in the Inaugural Class of the Athletic Hall of Fame for Culver Military Academy and received the Sagamore of the Wabash award from the Governor; and
WHEREAS, Judge Chipman was happily married to his “Bride Forever,” Ida Belle Hardin, for 70 years until her death on February 3, 2020. He is survived by his brother-in-law, Jim Hardin; his children Susan Nichter, E. Nelson Chipman Jr., Bryant Chipman Sr., and Kelsey Flynn; his grandchildren Jared Nichter, Hannah Nichter, Eugene Nelson “Chip” Chipman III, Mary Elizabeth Purcell, Maria Stopulos, Bryant Chipman Jr., Aaron Chipman, Christina Eddy Jr, Katie Flynn Friedman, Thomas Flynn, and Daniel Flynn. He was also survived by ten great-grandchildren with the eleventh one on the way; and
WHEREAS, Judge Chipman's passing is a loss to his community, our State, his family and friends, and this Court.
NOW, THEREFORE, BE IT RESOLVED, that this Memorial Resolution for the Honorable Eugene N. Chipman, Sr., be adopted by the Court of Appeals of Indiana and spread of record on the Order Book of this Court.
BE IT FURTHER RESOLVED, that the members of this Court extend their sympathy to the family and friends of this able lawyer and jurist and that a copy of the Memorial Resolution, under seal of this Court, be sent to his brother-in-law, to Jim Hardin and his children Susan Nichter, E. Nelson Chipman Jr., Bryant Chipman Sr., and Kelsey Flynn.
