IN RE: the Estate of Michael A. Porter, Paula Hardin, Appellant, v. Michael S. Porter, Appellee.
MEMORANDUM DECISION ON REHEARING
[1] Paula Hardin petitions for rehearing of the Court's original memorandum decision. Michael S. Porter has filed a response. We grant Hardin's petition to correct three misstatements, but we confirm our memorandum decision in all other respects.
[2] In paragraphs [10], [23] and [25] of our memorandum decision, we stated the trial court issued a warrant after Hardin failed to appear for a previously scheduled hearing. Hardin v. Porter, No. 24A-ES-1952, at * 5 (Ind. Ct. App. June 20, 2025) (mem.). Hardin correctly notes the trial court issued a writ, not a warrant, after Hardin failed to appear. Petition for Rehearing, pp. 4-5; Appellant's App. Vol. 2, p. 14. We concede the errors. But correcting those errors does not invalidate the underlying point: Hardin failed to diligently carry out her duties as personal representative.
[3] Hardin presents several other arguments in her petition for rehearing. We have reviewed them and conclude they do not require reconsideration of our memorandum decision.
[4] For these reasons, we grant Hardin's petition for rehearing and affirm our original memorandum decision, subject to the corrections discussed above.
