PETITION FOR REVIEW
The above-named Petitioner hereby petitions for review by this Court the final order of Court of Appeals, vacating the District Court's order granting post-conviction relief, issued on March 16, 2016. A copy of the decision is attached.
This petition is timely filed pursuant to Idaho Rules of Appellate Procedure § 118(a) as it is filed within 21 days of the Final Order issued in this matter. Petitioner asserts the grounds for this appeal are as follows:
1. The Court of Appeals has decided a question of substance not heretofore determined by the Supreme Court;
2. The Court of Appeals has decided a question of substance not in accord with applicable decisions of the Supreme Court of the United States;
3. The Court of Appeals has rendered a decision in conflict with previous decisions of the Court of Appeals.
A brief will be filed in support of Petitioner's Petition for Review within fourteen (14) days as prescribed by rule.
