COMES NOW, above named appellants, SHAWN MONTEE and HEATHER MONTEE, husband and wife, SHAWN MONTEE, INC., an Idaho corporation dba SHAWN MONTEE TIMBER COMPANY, and ABCO WOOD RECYCLING, LLC, an Idaho limited liability company (collectively “Appellants”) by and through their attorney of record, PAUL W. DAUGHARTY of the law firm PAUL W. DAUGHARTY, P.A., and pursuant to I.A.R. 42 hereby petitions the Court for rehearing on the following issues:

1. The decision of the Court affirming the district court's denial of the motion to continue filed pursuant to I.R.C.P. 56(f);

2. The decision of the Court affirming the the district court's grant of summary judgment as to the 2009 Note;

3. The decision of the Court affirming the district court's grant of post-judgment injunction; and

4. The decision of the Court which failed to address the other issues raised on appeal, including but not otherwise limited to, the district court's denial of the motion to quash order for examination of judgment debotrs and finding of contempt.

Pursuant to I.A.R. 42 Appellants will file a brief in support of this petition for rehearing with fourteen (14) days of filing. Provided, further, Appellants reserves the right to supplement the issues set forth above.
