PETITION FOR REVIEW PURSUANT TO IDAHO APPELLATE RULE 118
COMES NOW, the Respondent, by and through his counsel of record Anthony M. Pantera of the firm, Moore, Smith, Buxton, & Turcke, Chartered, and hereby requests, pursuant to Idaho Appellate Rule 118 that the State of Idaho Supreme Court review the written opinion issued by the Idaho Court of Appeals on October 17, 2016, (2016 Opinion No, 64) for the following reasons:
1. The Court of Appeals has decided a quest on of substance not heretofore determined by the Supreme Court, and
2. The Court of Appeals has decided a question of substance probably not in accord with applicable decisions of the Idaho Supreme Court or United States Supreme Court
Respondent shall submit a brief in support of this Petition within fourteen (14) days of submission.
