IT HEREBY IS ORDERED that Appellant's PETITION FOR REVIEW, be and hereby is GRANTED as to the issues presented in this appeal and shall be submitted to this Court for consideration on the briefs previously filed by the parties.

IT FURTHER IS ORDERED that the Court of Appeals Case No. 43292 is CLOSED and Supreme Court Case No. 44307 shall be used on all future filings in this proceeding.
