ORDER GRANTING PETITION FOR REVIEW
A PETITION FOR REVIEW was filed by counsel for Appellant on May 9, 2016, seeking the Idaho Supreme Court review the Second Substitute Opinion of the Court of Appeals in State v. Smith, Docket No. 42090, 2015 Opinion No. 54S2 (Idaho App., April 19, 2016). Thereafter, RESPONDENT'S BRIEF IN SUPPORT OF PETITION FOR REVIEW was filed on June 20, 2016. The Court is fully advised; therefore, good cause appearing,
IT HEREBY IS ORDERED that the PETITION FOR REVIEW, be and hereby is GRANTED as to the issues presented in this appeal and shall be submitted to this Court for consideration on the briefs previously filed by the parties.
IT FURTHER IS ORDERED that the Court of Appeals Case No. 42090 is CLOSED and Supreme Court Case No. 44308 shall be used on all future filings in this proceeding.
