CONCURRING AND DISSENTING ORDER BY LEONARD, J.
For the reasons stated in my February 16, 2018 Concurring and Dissenting Opinion, I concur with the majority's conclusion that the Family Court of the Fifth Circuit (Family Court) erred in its December 14, 2015 Findings of Fact; Conclusions of Law; Decision and Order Regarding Restitution Hearing (Restitution Order). However, I respectfully dissent from the majority's determination that the Restitution Order should be reversed in part, as concluded in the foregoing order. In light of the Family Court's misapprehension of the juvenile restitution statute, Hawaii Revised Statutes § 571-48 (2006), and to serve the ends of justice in this case, I would vacate the Restitution Order in its entirety and remand the case for further consideration of the appropriate disposition.
