IN RE: AMENDMENTS TO FLORIDA RULE OF CIVIL PROCEDURE 1.200.
The Florida Bar's Civil Procedure Rules Committee filed a report proposing amendments to Florida Rule of Civil Procedure 1.200 (Case Management; Pretrial Procedure).1 The Committee published the proposed amendments for comment on the Bar's website before filing them with the Court. Two comments were received, and the Committee declined to revise its proposal based on the comments. The Court republished the proposed amendments for comment. One comment was received from attorney Dan Cytryn, and the Committee filed a response to the comment.
Having considered the Committee's report, the comment filed, and the Committee's response, we decline to amend rule 1.200(h) as proposed by the Committee. We instead amend the rule to require courts to consider the “availability of the parties,” along with the needs of the case and the resources of the court, in setting a new trial period in a case that does not reach trial during the period set by court order.
Accordingly, the Florida Rules of Civil Procedure are amended as set forth in the appendix to this opinion. New language is indicated by underscoring; deletions are indicated by struck-through type. The amendments become effective on January 1, 2027, at 12:01 a.m.
It is so ordered.
