FLORIDA BAR v. FLEITES (2026)

The Court hereby approves the conditional guilty plea and consent judgment for discipline under the stipulated terms below.

Stipulation

Respondent is directed to receive a public reprimand administered in writing by the referee within 30 days of this order, and the disposition order will be published in the Southern Reporter.

Respondent is placed on probation for one year and must comply with the following conditions of probation. Respondent's noncompliance with any requirement is cause for contempt and additional disciplinary measures.

Respondent must retain, at respondent's expense, the services of a certified public accountant acceptable to The Florida Bar to review respondent's trust account records on a monthly basis during the term of probation. Respondent must submit the certified public accountant's name and contact information to The Florida Bar's headquarters office within 30 days of this order approving the consent judgment. Respondent must submit to The Florida Bar quarterly trust account reports prepared by the certified public accountant at The Florida Bar's headquarters office within 15 days of the end of each quarter (March 31, June 30, September 30, and December 31). The reports must specify whether respondent is in compliance with Chapter 5, Rules Regulating The Florida Bar, and must include the monthly reconciliations, copies of the bank statements of respondent's trust accounts, and a list of clients with the individual client trust account balances. Respondent must pay a quarterly monitoring fee of $100.00 to The Florida Bar at its headquarters office in Tallahassee no later than the end of each respective quarter in which the monitoring fee is due. Failure to pay constitutes cause to revoke probation.

Respondent must attend the Trust Accounting Workshop in person where scheduled by The Florida Bar, within 6 months of the date of this order. Respondent must pay all associated fees and costs before attendance.

Respondent is further directed to comply with all other terms and conditions set forth in the consent judgment.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Katiana B. Fleites in the amount of $3,622.35, for which sum let execution issue. These disciplinary costs are not dischargeable in any future proceedings, including, but not limited to, a petition for bankruptcy. Respondent will be delinquent and ineligible to practice law if respondent does not satisfy the cost judgment within 30 days of this order, unless The Florida Bar Board of Governors defers payment.
