IN RE: AMENDMENTS TO FLORIDA RULE OF CRIMINAL PROCEDURE 3.851 and Florida Rule of Appellate Procedure 9.142
After considering the petition, the Court declines to adopt the proposed amendments. The Court will consider, on its own motion, additional amendments to Florida Rule of Criminal Procedure 3.851 and Florida Rule of Appellate Procedure 9.142. Upon publication in Case No. SC21-537, of rule amendments being considered by the Court on its own motion, the Florida Supreme Court Criminal Court Steering Committee, as well as the Appellate Court Rules Committee and the Criminal Procedure Rules Committee, are directed to file a comment addressing the published alternative rule amendments and may file a response to any other comment received by the Court.
