SAMUEL E. ODOM, JR. Petitioner(s) v. STATE OF FLORIDA Respondent(s)
To the extent the petitioner seeks a writ of prohibition precluding the prosecution of David Matthew Miller, the petition is dismissed for lack of standing. See Public Defender, Eleventh Judicial Circuit of Fla. v. State, 115 So. 3d 261, 282-83 (Fla. 2013) (“[S]tanding ‘requires a would-be litigant to demonstrate that he or she reasonably expects to be affected by the outcome of the proceedings, either directly or indirectly.’ ” (quoting Hayes v. Guardianship of Thompson, 952 So. 2d 498, 505 (Fla. 2006))). To the extent the petitioner seeks a writ of mandamus compelling the circuit court to rule on his postconviction motion and seeks the type of relief available in a motion filed pursuant Florida Rule of Criminal Procedure 3.800, the petition is hereby dismissed without prejudice to the petitioner seeking relief in the appropriate courts. To the extent the petitioner seeks other relief, the petition is hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000). Any motions or other requests for relief are also denied. No motion for rehearing or reinstatement will be entertained by this Court.
