Malik LEWIS, Appellant, v. State of Florida DEPARTMENT OF REVENUE, CHILD SUPPORT PROGRAM, et al., Appellees.
In this appeal of the Florida Department of Revenue, Child Support Program's (“DOR”) final administrative child support order, Malik Lewis alleges his due process rights were violated because he did not receive notice of the December 17, 2025 hearing conducted by the Department of Administrative Hearings. The record, however, reveals that on September 29, 2025, a notice of the hearing was sent to Lewis at the address Lewis provided to DOR, and this notice was not returned to the sender. Generally, “[d]ue process does not require the affected person [to] receive notice; it only requires that the government give notice.” Miami-Dade Cnty. v. Wilson, 44 So. 3d 1266, 1270 (Fla. 3d DCA 2010); see Rodriguez v. Dep't of Bus. & Pro. Regul., 326 So. 3d 796, 799 (Fla. 3d DCA 2021) (holding that agency's mailing to address of record met due process in administrative proceeding).
Affirmed.
