Earl James RAY Jr., Appellant, v. Mark S. INCH, Secretary, Florida Department of Corrections, Appellee.
Because we find no error in the circuit court's order dismissing Appellant's mandamus petition as untimely, we deny Appellee's motion for remand and summarily affirm the circuit court's order. See Fla. R. App. P. 9.315(a). However, Appellant may pursue the “alternative avenue of review” set out in Gundlah v. Moore, 831 So. 2d 780 (Fla. 4th DCA 2002).
Per Curiam.
Wolf, Kelsey, and Winokur, JJ., concur.
