ORDERED that petitioner's notice of voluntary dismissal is recognized by the Court, and this emergency petition for writ of certiorari is hereby dismissed.
Upon consideration of respondents' motion for appellate attorneys' fees, it is ordered that said motion is conditionally granted and remanded to the trial court to fix amount, contingent upon prevailing party determination at close of case.
