Max Valnet Claircius, Appellant, v. Alicia Claircius n/k/a Alicia Self, Appellee.
Max Valnet Claircius appeals two orders rendered in a dissolution of marriage proceeding: an order determining that the trial court has personal jurisdiction over Claircius (the “Jurisdictional Order”); and an order denying Claircius's petition for writ of quo warranto directed at Appellee's counsel (the “Denial Order”). We have appeal jurisdiction to review the Jurisdictional Order, and we affirm. See Fla. R. App. P. 9.130(a)(3)(C)(i). The Denial Order, however, is a nonfinal, nonappealable order because it is not “[a]n order denying a petition that initiates a civil action in quo warranto in the circuit court ․” Philip J. Padovano, Florida Appellate Practice § 30:4 (2026 ed.) (emphasis added). Therefore, we treat the appeal of the Denial Order as a petition for writ of certiorari and deny the petition on the merits. See Fla. R. App. P. 9.040(c) (“If a party seeks an improper remedy, the cause must be treated as if the proper remedy had been sought ․”); Padovano, supra, § 30:4 (“A party may file a petition for writ of quo warranto to challenge the authority of a public official.” (emphasis added)).
AFFIRMED in part; DENIED in part.
WHITE, J.
WOZNIAK and GANNAM, JJ., concur.
