Kirby of Norwich, Inc. v. Administrator, Unemployment Compensation Act et al.
MEMORANDUM OF DECISION
This vigorously contested matter involves a statutory appeal concerning unemployment compensation. The Employment Security Board of Review has certified the Record of this appeal to court. The plaintiff has followed the appropriate path of administrative appeals to ultimately bring his appeal to the Superior Court pursuant to Section 31–249b of the General Statutes. The board has found an employer/employee relationship from the facts before it. It is significant to note that no motion to correct the findings of the Board was filed. The court does not retry the facts. The court is bound by the facts found by the Board of Review and the reasonable conclusions reached from them.
The parties appeared in argument of their respective positions before the court at New London where both parties were represented by counsel. Briefs have been filed expressing their respective positions.
In this case the record is replete with evidence to support the conclusion of the Board that an employer-employee relationship existed.
The plaintiff's appeal is dismissed.
