Fortunata Maluccio v. East Lyme Zoning Board of Appeals
MEMORANDUM OF DECISION
After the court issued a Memorandum of Decision in the above appeal from the actions of the Zoning Board of Appeals of the Town of East Lyme (ZBA), the ZBA filed its Motion for Reargument pursuant to Section 11–11 of the Practice Book.
The matter was set down for a hearing held on this date before the trial court where both parties were well represented by counsel. Argument was heard as to the relief sought. The ZBA requested the court to consider a matter of law which it claimed was overlooked by the court. The plaintiff objected to the request.
Having carefully considered the arguments of counsel and the briefs filed in advance of the hearing, the Motion is granted, but the relief requested therein is denied.
