Bonnie Duart v. Ryan Gugliuzza et al.
MEMORANDUM OF DECISION RE PLAINTIFF'S MOTION TO REARGUE
The court replies to the plaintiff's motion to reargue as follows:
On July 9, 2014, prior to the trial of this motion, defendant, Ryan Gugliuzza, was defaulted for failure to appear and judgment was entered against him for $51,620.56, interest of $4,447.56, costs of $400.00 and attorneys fees of $4,725.00, payable $50.00 per week commencing July 23, 2014.
Accordingly, the court vacates its findings that Gugliuzza is not personally liable to the plaintiff and finds that he is liable to the plaintiff for the judgment entered July 9, 2014. In addition, the court enters judgment against Gugliuzza in favor of the plaintiff in the amount of $2,600.00 for personal loans made by the plaintiff to Gugliuzza described in Exhibit B to the court's memorandum of decision.
The court makes no finding as to a CUTPA violation and unjust enrichment against Gugliuzza because the plaintiff failed to offer sufficient evidence as to such counts.
