MEMORANDUM OF DECISION RE MOTION # 103 MOTION TO DISMISS
The foregoing matter having been heard by the court (Iannotti, J.) enters orders as follows:
The Court finds that the instant action should have been brought under Section 2–41 of the Connecticut Practice Book by the Plaintiff instead of as currently pled under Section 2–39.
Accordingly, the court enters an order dismissing this action without prejudice.
