Jill Mahoney v. Randall Mahoney
MEMORANDUM OF DECISION
This is an action to dissolve the twenty-one-year marriage of the parties.
At the commencement of this trial the parties entered into a written stipulation as to what agreements they had been able to reach and what issues they wished the court to decide. Their agreement provided for custody and visitation, the costs of extracurricular activities and college expenses, the disposition of mutual fund accounts held for the children, the payment of medical and life insurances, and the division of debts. Their agreement also provided for the disposition of the marital residence and time-share properties, the division of personal property and bank accounts, the filing of tax returns, and the division of pensions, 401K and IRA accounts.
The parties identified the only issue in dispute as the amount and duration of alimony to be paid to the plaintiff (the defendant waived any claim of alimony from the plaintiff).
The court has considered all statutory provisions and case law affecting the issues in this case as well as the testimony and evidence provided by the parties. The court enters the following orders.
A. DISSOLUTION OF MARRIAGE
The marriage of the parties is hereby dissolved on the grounds of irretrievable breakdown and each party is declared to be single and unmarried.
B. WRITTEN STIPULATION OF THE PARTIES
The written stipulation of the parties dated December 4, 2013 is accepted by the court and is hereby incorporated into this judgment.
C. RESERVATION OF JURISDICTION FOR EDUCATIONAL SUPPORT ORDERS
Pursuant to the agreement of the parties the court shall retain jurisdiction to enter educational support orders in the future pursuant to Connecticut General Statutes, Section 46b–56c.
D. RESERVATION OF JURISDICTION FOR QDROs
Pursuant to the agreement of the parties the court shall retain jurisdiction in order to process the QDROs. The parties are to submit the QDROs to the clerk's office no later than 60 days from the date of this judgment.
E. PARENTING EDUCATION PROGRAM
The defendant shall complete the parenting education program and provide evidence thereof to the clerk's office by February 4, 2014.
F. ALIMONY
The defendant shall pay to the plaintiff the sum of $100 per week in periodic alimony. Alimony is to terminate upon the earliest of the following events:
1. The death of the plaintiff;
2. The death of the defendant;
3. The remarriage of the plaintiff;
4. The cohabitation of the plaintiff under circumstances that alter her financial circumstances in accordance with statute and case law; or
5. Ten years from the date of this judgment.
Alimony shall be modifiable as to amount but not as to term.
G. MISCELLANEOUS PROVISIONS
1. The parties are to exchange copies of their state and federal tax returns, by certified mail return receipt or registered mail, by April 15 of each year, so long as there is an outstanding child support or alimony order or outstanding arrearage regarding such orders.
2. Each party is to immediately give written notification of any change in that party's employment to the other party.
3. Each party is to immediately notify the other party of any change in their residence or mailing addresses.
4. Counsel for the plaintiff is to prepare the judgment file within 30 days and send it to counsel for the defendant, who shall sign the judgment file and return it to court within 15 days of his receipt of same.
