Chandra Bozelko v. Tina Sypek D'Amato et al.
MEMORANDUM OF DECISION
The order of this court entered on March 18, 2013 granting defendants' Request to Revise dated September 27, 2012[128], is hereby vacated. The court's action was erroneous. The court's confusion led to its error.
On February 7, 2013, in response to defendants' November 13, 2012 Motion For Nonsuit [132], the following order was entered:
# 132—nonsuit granted—plaintiff is allowed until March 15, 2013 to file her memorandum re her objection(s) to the request to revise.
On February 21, 2013, plaintiff filed her MEMORANDUM OF LAW IN SUPPORT OF OBJECTION TO REQUEST TO REVISE, dated November 11, 2012[138].
On March 18, 2013, the court entered the following order regarding defendants' September 27, 2012 Request to Revise [128]:
# 128—granted.
# 129—noted—memo articulating the objections has not been filed although more than sufficient time has elapsed for same.
[128.01]
The court's granting the Request to Revise was mistaken as plaintiff's MEMORANDUM OF LAW IN SUPPORT OF OBJECTION TO REQUEST TO REVISE, dated November 11, 2012[138], had been filed on February 21, 2013, well before the court's March 15, 2013 deadline for filing same.
