Memorandum of Decision
The court has fully considered the criteria of C.G.S. Sec. 46b–40–86, as well as the evidence, applicable case law, the demeanor and credibility of the witnesses in reaching the decisions reflected in the orders that issue in this decision.
The parties have returned to the court several times regarding plaintiff's Motion for Contempt, # 176.79, dated August 6, 2013. The court issued rulings on all claims on the record with the exception of the following claim.
The court finds the defendant in contempt of the court order regarding monthly alimony payments of 40% of the defendant's income, but no less than $1,750 per month. The parties were divorced March 18, 2013. The defendant was ordered to pay unallocated alimony and support on a monthly basis for a term of 15 years, with a decreasing percentage over the term. Until May 31, 2016, defendant is ordered to pay an amount equal to 40% of his gross monthly income, but no less than $1,750 per month. The court finds credible testimony that the defendant failed to pay 40% of his income for the months of July and August 2013. Since the date of the judgment, the minimum amount of alimony and support that should have been paid is $14,000. ($1,750 x 8 months.) Defendant's own evidence indicates he falls short of that amount.
Defendant is ordered to reimburse plaintiff the amount of $2,633.60. He is ordered to pay an additional $400 per month until that sum is repaid.
