Commissioner of Transportation v. David Martorelli et al.
MEMORANDUM OF DECISION
The applicant David Martorelli et al. has commenced this action for reassessment of damages. On October 4, 2012 the Commissioner of Transportation had condemned applicant's property and filed an Assessment of Damages for the sum of $211,500. The applicant has filed an appeal of that assessment. Each party has presented evidence of comparable sales of similar properties in support of their valuations of the subject properties. The applicant contends in response to the assessed value of the plaintiff that the proper fair market value of the property is $326,000.00.
After hearing all the evidence presented by both parties that comparable # 1 located at 1025 Broad Street, Meriden, Connecticut is offered by both sides regarding the sales approach. This property is a two-story brick mixed use commercial-residential structure. This property was sold on 1/24/12 for $275,000. The appraiser for the applicant found that after adjustments this property had a 4.228 square foot value which rounded to $70.00 a square foot which rounded to $296,000.00. The plaintiff's appraiser made adjustments as to comparables because subject property had an attached shed and this comparable had a three-car garage and I find that would reduce the fair market value to $290,000.00.
Based upon the above the reassessment of damages pursuant to Connecticut General Statute 13a–26 is found to be $290,000.
