MEMORANDUM OF DECISION ON DEFENDANTS' MOTION TO STRIKE
A claim of common-law reckless based on young driver operating with one more passenger than permitted under Connecticut General Statutes § 14–36q(a)2 and after being distracted going through a red light is not substantiated under criteria set forth in Dubay v. Irish, 207 Conn. 518 (1988) as a wilful, wanton or intentional act.
Motion to strike count three is granted.
