Frank W. Bertino v. Garden Catering
MEMORANDUM OF DECISION RE MOTION TO DISMISS (117.00)
This case has previously seen several motions to dismiss the complaint as against other defendants granted. Two such motions were granted by this court on June 3, 2013. Dkt. Entry 104.86. A similar motion was granted by the Honorable Kenneth Povadator on July 10, 2013. Dkt. Entry 113.86. Now before this court is a motion to dismiss by the defendant identified as Nathaniel Witherell, a nursing home in Greenwich, Connecticut.
The plaintiff is Frank Bertino, Jr. representing himself. He has not filed any opposition papers.
It will serve no purpose to rehash the reasons why this and the other motions to dismiss will be, and have been, successful. The complaint is based on the treatment, or lack thereof, afforded the plaintiff's father who died November 20, 2012. Therefore, for the reasons stated in the pending motion, and set forth in the two decisions on similar motions referred to above, the court grants the motion of Nathaniel Witherell to dismiss the complaint.
