Memorandum of Decision on Magistrate Appeal
This matter came before the court on appeal from the magistrate court dated March 6, 2013 taken by Magistrate Harris T. Lifshitz, in a decision that found the Defendant contempt of court resulting in his incarceration. This court has reviewed testimony, argument, transcripts of the magistrate proceeding, and any evidence presented to court on March 6, 2013. This court finds that the magistrate could have reasonably concluded that there was a valid court order, a willful violation of the order, and an ability by the Defendant to have met the court order. Furthermore, based on an agreement of the parties, the Court lowered the Defendant's purge to $1,000.00. Therefore, this appeal is denied.
