Bradshaw Smith v. Commissioner, Connecticut Department of Agriculture
MEMORANDUM OF DECISION
The Plaintiff filed a petition dated November 28, 2012 appealing from a decision dated October 19, 2012 by the commissioner, Connecticut Department of Agriculture. The Commission dismissed the appeal because this Court lacks subject matter jurisdiction over the matter due to mootness.
On February 27, 2013 the defendant filed a motion to dismiss this administrative appeal on the basis that this Court lacks subject matter jurisdiction over the matter due to mootness and filed a memorandum of law in support of its claim. The Court grants the Defendant's motion to dismiss since the dog Dominique is the subject matter of Plaintiff's action is deceased and can no longer be subject to any restraint order conditions. Any purported exceptions to the doctrine of mootness are simply inapplicable.
Plaintiff's action is dismissed.
