Michael Eylward v. Channing Cooney et al.
MEMORANDUM OF DECISION
Plaintiff was a passenger in a vehicle operated by Channing Taylor Cooney who plaintiff alleges was intoxicated when served drinks by the defendants. The plaintiff was injured in an accident as a result of negligence and intoxication of the operator.
Plaintiff withdrew the claim against the defendant Channing Taylor Cooney. The remaining defendants were defaulted for failure to appear and a judgment was entered for the plaintiff against the remaining defendants.
At a hearing in damages the evidence established plaintiff sustained severe injuries to his face and numerous fractures of his leg, foot, arm and internally which required seven surgeries, and confinement in the hospital and Gaylord Rehabilitation facility.
The plaintiff as a result of the injuries could not work for approximately a year and he incurred medical bills of approximately $391,000.00 and lost wages of $30,000.00 plus permanent disabilities of his wrist, leg, and foot.
Judgment is entered against the defendants for $1,400,000.00.
