CLARIFIED MEMORANDUM OF DECISION (Clarification of Memorandum of Decision filed May 30, 2013(253)
The court issued a Memorandum of Decision filed and entered orders in connection with several pending motions. On June 11, 2013, the defendant filed the aforementioned Motion for Clarification.
The motion is granted and the court clarifies its memorandum in the following respects (the numbered paragraphs correspond to the paragraphs in the defendant's motion):
1. The plaintiff, at the time, has limited financial resources (albeit the court found the plaintiff willfully limited his resources). Given the current circumstances, the court did not order a lump sum payment towards the arrearage due for unreimbursed medical expenses, extracurricular and camp costs, health insurance premiums and the Webster HELOC. The court did not include a minimum payment from the plaintiff to be applied to the current arrearages in the hope that the plaintiff would use his resources to pay the current payments of child support and such related support expenses when due, together with the payment of the $20 towards the arrearage. At this time, the court declines to enter an order on the repayment of the arrearages for the aforesaid expenses, but the right of the defendant to request the same is, certainly, reserved.
2. The May insurance premium of $413 is added to the arrearage of health insurance premiums—accordingly, the arrearage as of May 30, 2013 is $413 plus $10,852 or $11,265.
3. The child support payments of $100 for May 24, 2013 and May 31, 2013, which came due before the issuance of (for the May 24 payment) and the receipt of (for the May 31 payment) the memorandum are added to the child support arrearage. The arrearage then as of May 31, 2013 is $200 plus $12,300 or $12,500.
4. The arrearage of $5,366.68 is the arrearage due on the Webster HELOC as of May 31, 2013.
