RULING ON PLAINTIFF'S MOTION FOR ATTORNEYS FEES
The plaintiff seeks attorneys fees and costs pursuant to the commercial lease agreement dated October 25, 2010, paragraph 10. (Plaintiff's Trial Exhibit 2.) These are the fees and costs that were incurred in connection with both the summary process and rent collection civil action. Pursuant to the October 2, 2012 memorandum of decision, the plaintiff has filed its claim in the form of time records and an attorney's affidavit.
The attorneys fees for the summary process case are separately stated from the civil action. The defendant did not file a written objection to the plaintiff's request.
A hearing was held on March 4, 2013, at which time the court heard oral argument. Based upon the record presented, and work reasonably performed, the court awards the following attorneys fees and costs:
a) summary process case, $3,000 attorneys fees, $269.20 1 costs;
b) civil action, $6,500 attorneys fees, $598 costs.
