Opinion TitleSUPPLEMENTAL TO MEMORANDUM OF DECISION MARCH 21, 2013 The court has reconsidered its decision and hereby enters an amendment to the memorandum dated March 21, 2013 in the above captioned matter. The amendment pertains only to the relief ordered by the court. The rest of the memorandum of decision stands as it is. Additionally, the court finds that the re-arguments sought by both parties are unnecessary, and are, therefore, denied. Because the defendants have already taken the benefit of tax credits for years 2009 and 2010, such credits are not available to the plaintiffs and other relief must be awarded. Consequently, the defendants are hereby ordered to pay monetary damages in the amount of Two Hundred Thousand Dollars ($200,000.00) to the plaintiffs, representing the value of the tax credits the defendants wrongfully took. For the year 2012 and onward the defendants are ordered to cause to assign the tax credits (in total $800,000.00) to the plaintiffs as per the schedule stipulated to by the parties. Pursuant to General Statutes § 37–3a, interest at the rate of ten percent per year is awarded on the Two Hundred Thousand Dollars ($200,000.00). Judgment may enter accordingly. BY THE COURT, M.
