Corina Buzzard v. Steven Buzzard
MEMORANDUM OF DECISION REGARDING PLAINTIFF'S MOTION FOR MODIFICATION (116)
A review of the record reveals that the parties were divorced pursuant to a legal separation agreement on December 17, 2009. The plaintiff wife was awarded one dollar per year alimony and the judgment made no reference to it terminating, even upon the occasion of her remarriage. The plaintiff filed a motion for modification of her alimony on March 4, 2013 and gave notice to the defendant by publication. The marshal's return indicates that the publication was made.
The plaintiff appeared before the undersigned and the defendant did not appear. The plaintiff claimed that she has become permanently and totally disabled and that her income has gone from $782 per week as her net take-home pay to $1,659 per month or $386 per week from her Social Security disability stipend. The court finds this to be a substantial change in circumstances.
ORDER
The defendant is ordered to pay to the plaintiff $200 per week alimony.
