Facts
Motion involves child support for the parties' child Robert, d.o.b. December 4, 1994, during the months of January through May 2012;
Robert has resided with the father/defendant since 2009;
Current order requires mother/plaintiff to pay child support for Robert until he reaches the age of 18 or finish high school;
Robert was treated at the residential facilities of St. Vincent Behavioral Health Center where he stayed as a patient from January 2012, through May 2012. Robert then returned to the defendant's home;
The defendant asked for and received support services from the department of children and families. The treatment was strictly voluntary.
Findings
Mother is responsible for child support of the minor child Robert during the months of January through May 2012.
The minor child's primary residence did not change during his stay in a residential treatment facility. The defendant was still required to maintain a permanent residence for the minors with all those associated costs. His stay at the health facility was similar to any other hospital stay and did not affect plaintiff's obligation to pay support.
