ORDER RE MOTION FOR REMITTITUR (# 188)
The evidence at trial indicated that the plaintiff sustained permanent injuries to her finger and hand when she fell from a treadmill during a stress test conducted by a nurse and employee of the defendant.
The jury heard evidence for three days which included testimony as to the lasting and permanent effects of said injuries on the plaintiff's personal and professional life experience. The jury considered the evidence in a careful manner. There is no proof or information of any “partiality, prejudice, mistake or corruption” in the jury's verdict. Further, the court does not find the jury's verdict “excessive or exorbitant.” Saleh v. Ribeiro Trucking, LLC, 303 Conn. 276, 280–82 (2011).
The jury's verdict remains and the Defendant's motion is denied.
