ORDER REGARDING:  01/04/12 179.00 MOTION TO REARGUE/RECONSIDER

The foregoing, having been considered by the Court, is hereby:

ORDER

The court granted the plaintiff's motion to reargue and/or reconsider its ruling regarding the denial of the Motion to require the Town of North Branford to Turn-over funds.   The court has carefully considered the position of the parties, and the arguments of counsel.   The request to reverse the court's earlier decision regarding funds to the Town of North Branford is denied.

However, the court is persuaded that funds due the LLC were improperly tendered to the Town, in violation of a clear Court Order.   The attorney for defendant Spezzano made several arguments as to why the funds should not be subject to the Court Order, which the court finds to be without legal merit.
