State of Connecticut v. Kelly A. Danforth
MEMORANDUM OF DECISION
The reason this court denied the defendant's motion to dismiss is provided in the case the defendant cites: State v. Patterson, 276 Conn. 452, 480–84 (2005). Citing State v. Davis, 255 Conn. 782 (2001), the Patterson court distinguishes the use of Connecticut General Statutes § 53–202k in accessory and conspiracy cases. In this defendant's case no misapplication of the law occurred: substantial evidence indicated that she not only directed events, but she was also instrumental in procuring the firearm for the principal to use in the robbery.
