MEMORANDUM OF DECISION

The court has examined the Exhibits in evidence in this case and based on those Exhibits makes the following findings:

C. World, Inc., Sifwat Ali and Foziz N. Ali are each individually responsible to repay the funds paid to C. World, Inc. by the plaintiff in the principal amount of $44,387.02 together with interest from July 18, 2009 at the rate of prime plus 1.25% together with late charges of 5% of each payment due, plus attorneys fees and costs.

Judgment on the first count of the complaint is based upon Exhibit 1, the business credit application of C. World, Inc. and the disbursements to the corporation as shown on the Transaction History of Exhibit 3.

Judgment on the second count is based on the Transaction History (Ex. 3) and the personal Guarantee of Sifwat Ali (Ex. 1).

Judgment on the third count is based on the Transaction History (Ex. 3) and the personal Guarantee of Foziz N. Ali (Ex. 1).

Judgment may enter on all three counts in favor of the plaintiff and against each defendant individually on the count addressed to that defendant for the principal sum of $44,387.02 plus interest of prime plus 1.25% and late charges at the rate of 5.00% of each payment due, together with an attorneys fee of $3,665 plus costs of $384.00 (Ex. 5).
