ORDER RE MOTION TO STRIKE (# 118)
On October 4, 2011, the plaintiff filed a motion to strike the defendants' special defenses accompanied by a memorandum of law in support thereof. On October 24, 2011, the motion was scheduled for short calendar and the court took the papers. On the next day, October 25, 2011, the defendants filed an amended answer and special defenses. While the motion to strike was still pending, the plaintiff filed a reply to the special defenses on December 12, 2011. Also on December 12, 2011, the plaintiff filed a certificate of closed pleadings. See Practice Book § 14–8(a). Therefore, as the motion to strike has been superceded by subsequent pleadings and the plaintiff has now certified that the pleadings are closed, the motion to strike is moot and the court cannot adjudicate the motion.
