MEMORANDUM OF DECISION RE OBJECTION TO PRODUCTION # 244 AND OBJECTION TO PRODUCTION # 245, REPLY # 242.01
This matter comes to this court as Objections to Products of Documents. The court heard oral argument, reviewed the pleadings. The parties have limited their objections in # 244 to # s 5, 12, 14,15 and 23.
As to objection # 244, the court rules as follows:
1. As to # 5, the objection is sustained as to the years 2002, 2003. The other years are to be produced. Documents claimed to be attorney/client privilege need not be produced.
2. As to # 12, the objection is overruled except as to documents that are attorney/client privilege. The objection is overruled as to payments made from 2004 forward, except as to attorney/client privileged materials.
3. As to # 15, the objection is overruled except for documents that reflect attorney/client privilege. The objection is overruled except as to the attorney/client privileged materials.
Objections have been limited in # 245 to # s 13, 14 and 15.
As to Objection # 245, the court rules as follows:
1. As to Paragraph # 13, the objection is sustained.
2. As to Paragraph # 14, the objection is sustained
3. As to Paragraph # 15, the objection is overruled except as to attorney/client privileged materials and work product.
