Cynthia Kasper v. John Valluzzo
ORDER
The court hereby orders that both parties each file an affidavit pursuant to Gen.Stat. § 46b–73(a) concerning the January 30, 2009 Amended Final Judgment for Dissolution of Marriage issued in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida, Docket Number DR 06–2932 FC entitled Cynthia Kasper Petitioner/Wife and John Valluzzo Respondent/Husband.
The court notes that the defendant's Motion for Stay dated August 5, 2009 (# 104.00) was granted by the court, Harrigan, J.T.R., in a November 18, 2009 Memorandum of Decision (# 109.00.) More than two years has elapsed since the issuance of that court ordered stay.
Whether or not the events stated in Gen.Stat. § 46b–73(a) and (b) have occurred shall be stated in the affidavit as well as the underlying facts surrounding those events. The docket number or case number, and the complete name and address of each court, whether Florida trial or appellate courts, shall also be contained in the affidavit.
Any party shall have the right to file a motion or motions pursuant to Gen.Stat. § 46b–73(c). Regardless of that right, the plaintiff and defendant are hereby ordered to file these affidavits as a pleading in the above file.
The affidavits shall be filed with the clerk on or before December 15, 2011. A copy of the filed affidavit shall be furnished to the undersigned c/o the Judge's secretary, Superior Court, 123 Hoyt Street, Stamford, CT 06905.
