Tasha Solomon et al. v. Maria Corujo
MEMORANDUM OF DECISION
This is a civil action wherein the plaintiff Tasha Solomon is seeking money damages on her own behalf and on behalf of her minor son De‘Or Freeman. The claims arise out of an automobile accident which occurred on September 6, 2007 at the intersection of Whalley Avenue and Norton Street in New Haven, Connecticut.
The plaintiff alleges that she was operating her car when it was in collision with a vehicle operated by the defendant and that the collision was caused by the negligence of the defendant. The plaintiff claims that both she and her 4–year–old were injured in the accident.
The defendant has been defaulted for failure to appear. She is not in the military service. The court heard the matter as a hearing in damages on September 28, 2011.
As a result of the collision the plaintiff suffered an acute cervical strain/sprain, an acute thoracic strain/sprain, and an acute lumbar sprain/strain. She incurred expenses at the New Haven Chiropractic Group totaling $1,501.00.
As a result of the collision De‘Or suffered an acute thoracic strain/sprain with mild paraspinal muscle spasms. He has incurred expenses for ambulance service, hospital, medical and chiropractic services totaling $2,141.14.
The court finds that the plaintiff's economic damages are $1,501.00 and that fair and reasonable non-economic damages are $4,000.00. There are no collateral source payments.
The court finds that De‘Or has sustained economic damages totaling $2,141.14, and noneconomic damages of $5,000.00. There are no collateral source payments.
A judgment may enter on the first count in favor of the plaintiff in the amount of $5,501.00.
A judgment may enter on the second count in favor of De‘Or Freeman ppa Tasha Soloman in the amount of $7,141.14.
The third count is dismissed.
