Lisa DiPinto v. Michael DiPinto
CORRECTED MEMORANDUM OF DECISION (Correction to Memorandum of Decision dated August 31, 2011. Correction made was re scrivener's errors)
The court hereby corrects the following scrivener's errors in the Memorandum of Decision dated and filed August 31, 2011.
1. In the seventh paragraph of the section of the Memorandum of Decision entitled “Findings of Fact” the sum of $185,000 is deleted and the sum of $285,000 inserted in lieu thereof and further the sum of $180,000 is deleted and the sum of $280,000 inserted in lieu thereof. It is the intention of the court to rectify the finding of the court of the amount of an offer for the purchase of the marital home.
2. In the section of the Memorandum of Decision entitled “Additional Findings and Orders,” the first three sentences of Section D.1. are deleted and the following inserted in lieu thereof:
“1. Marital home. It is the intention of the court that the home be sold as quickly as possible. In order to facilitate such intention, the defendant shall quit claim to the plaintiff all of his right, title and interest in and to the 260 Ratlum Road, New Hartford property on or before September 30, 2011. On or before September 30, 2011, the defendant shall vacate the home and leave it broom clean and in good condition.”
It is the intention of the court to correct a date which was inadvertently set forth as September 30, 2001 instead of September 30, 2011.
As corrected herein, the Memorandum is hereby confirmed.
