MEMORANDUM OF DECISION RE PLAINTIFF'S MOTION TO MODIFY CODED 135
Many of the facts that give rise to this motion are not in dispute. The marriage between the parties was dissolved on January 28, 2010. The plaintiff's gross weekly income at that time was $652 and his net weekly income was $512. The defendant's net weekly income was $220. The threshold issue is whether the plaintiff has shown that there is a substantial change of circumstances since that day. The court finds that the plaintiff's current gross weekly income is $354.01 less deductions for a net weekly income of $270. The court finds that there has been a substantial change of circumstances since the date of dissolution. The court finds that in accordance with the defendant's financial affidavit dated July 25, 2011 that her net weekly income is $159. The court has considered all the circumstances that are considered at the time of entering dissolution and enters the following order.
1. Alimony is reduced from $200 per week to $100 per week.
2. The order is retroactive to February 28, 2011 for total of twenty-three weeks of retroactivity.
