Jeff Howes v. Kathie–Sue Howes
MEMORANDUM OF DECISION REGARDING PLAINTIFF'S MOTION FOR COUNSEL FEES
A review of the record reveals that the parties were divorced pursuant to a marital separation agreement dated September 29, 2010. Since that date, the plaintiff has been forced to return to court on numerous occasions to pursue motions enforcing the terms of the judgment related to the sale of the marital residence.
Plaintiff's counsel submitted invoices accumulated between November 15, 2010 and April 5, 2011 in the amount of $3,514.01 as follows:
December 17, 2010 $480.00
January 31, 2011 $875.51
March 4, 2011 $1,858.20
April 5, 2011 $300.00
In addition, plaintiff was compelled to summon to court Attorney Camassar, who was effectuating the closing for an additional two hours or $450.
Wherefore, the defendant shall pay to the plaintiff $3,963.71 within 90 days.
