Daniel Seufert et al. v. Temple Management, LLC et al.
MEMORANDUM OF DECISION
This matter was before the court as a hearing in damages following the defendants being defaulted for failure to comply with Silbert, J.'s October 12, 2010 Order of Compliance.
The evidence disclosed that the plaintiffs, students at Quinnipiac College, entered into a lease agreement with the defendants for premises known as 3327 Whitney Avenue. The lease required that plaintiffs deposit with the landlord a security deposit in the amount of $2,900.00 for the term of the one-year lease. Plaintiff's Exhibit 1 is a letter from Jacob Bergman, agent for Temple Management, dated December 22, 2008 advising the plaintiffs that they must vacate the premises as the rental property is under contract and is to be sold to Quinnipiac University. Although the plaintiffs made demand for the return of their deposit, the defendants failed to return same. Although the defendant offered to rent a new place to the plaintiffs at reduced rent to compensate the plaintiffs for their retained deposit, the court is sympathetic with the plaintiffs' refusal to do further business with the defendants.
Judgment may enter in favor of the plaintiffs in the sum of $2,900.00 together with interest at 10% per annum on said sum to run from January 1, 2009 to such time as said judgment is paid in full.
